More homeowners, particularly those aged 55 and over, are considering equity release as a way to access funds tied up in their property. Luisa Court from Harding Evans’ Residential Conveyancing team explains why independent legal advice is an important safeguard throughout the process.
Equity release may be used for a range of reasons, from home improvements and travel to meeting wider financial needs. However, these arrangements can have long-term consequences, which is why lenders require borrowers to obtain independent legal advice from a solicitor before completion.
By the time a client meets with a solicitor, they will have already received financial advice and chosen an equity release product. The solicitor’s role is not to advise on whether equity release is the right financial decision, but to explain the legal terms and ensure the client understands the commitment they are entering into.
This advice also provides an important safeguarding function. The solicitor must be satisfied that the client is acting voluntarily, without pressure, and has the mental capacity to proceed. This protects the client and everyone involved in the transaction.
Once the lender issues the legal documents, the solicitor reviews the offer, carries out identity and anti-money laundering checks, and arranges a meeting with the client. During the appointment, they explain the key terms, discuss the client’s legal obligations, answer questions and confirm that the decision is being made freely and with full understanding.
Only when the solicitor is satisfied that the client understands the transaction will the legal documents be signed and returned to the lender’s solicitor, allowing the matter to move towards completion.
Independent legal advice should therefore be seen as more than a lender requirement. It gives clients the opportunity to understand the legal commitment being made, ask questions in an impartial setting and proceed with confidence that their decision is informed and fully understood.
